State consumer affairs officials have filed a suit against Newton’s NVE Pharmaceuticals, a maker of dietary supplements, alleging the company misled consumers about its weight-loss products that contained the now-banned herbal stimulant ephedra.In a report Thursday, the Associated Press said the lawsuit alleges that NVE Pharmaceuticals, which is best-known for its Stacker 2 line of supplements, and its president, Robert Occhifinto, advertised the ephedra-based supplements as safe, despite receiving complaints from consumers about a range of side effects, including high blood pressure, rapid heartbeat, chest pains, seizures, abnormal bleeding, kidney problems and insomnia.The suit, filed Friday and announced Wednesday, seeks civil penalties and restitution for affected consumers, the news agency said, adding that it also seeks to bar the company from making false and misleading claims about the safety and effectiveness of its products.The suit comes several months after a federal judge in Newark allowed a Food and Drug Administration ban on ephedra to take effect.Before the April 12 ruling, NVE marketed 80 products containing ephedra, state officials said. The company still makes Stacker 2 Ephedra-Free, a caffeine-based weight-loss supplement.
