President Donald Trump is nominating Alina Habba to a full four-year term as U.S. Attorney for the District of New Jersey.
The White House announced July 1 that Habba’s name was submitted to the Senate for confirmation. Her initial term is due to expire later this month.
Under federal statue, an interim U.S. Attorney serves a maximum of 120 days unless formally nominated by the president and confirmed by the Senate. New Jersey’s federal judges may also vote for an extension.
Trump tapped his longtime personal attorney-turned-presidential counselor to serve as interim U.S. attorney in March. Habba succeeded John Giordano, who held the post for about two weeks. Before joining the Trump administration, Habba represented the president in multiple legal battles over the years.
A graduate of Widener University School of Law, Habba previously served as managing partner at Habba Madaio & Associates LLP. Her practice focused on civil litigation and corporate law at the Bedminster firm.
In naming her as interim, Trump said it was a “great pleasure” and that he believes she “will fight tirelessly to secure a Legal System that is both ‘Fair and Just’ for the wonderful people of New Jersey.”
Habba made headlines for charging Newark Mayor Ras Baraka for allegedly trespassing at Delaney Hall, a privately run federal immigration detention center in the city. The charges were later dropped, but Baraka has since sued federal officials for “false arrest and malicious prosecution.”
She has also brought charges against U.S. Rep. LaMonica McIver, D-10th District, for allegedly “assaulting, impeding and interfering with law enforcement” at Delaney Hall. McIver recently pleaded not guilty.
Following the White House’s announcement regarding Habba’s nomination, Sens. Andy Kim and Cory Booker, both Democrats, issued a joint statement:
The people of New Jersey deserve a US Attorney that has deep experience with law enforcement, a reputation and an approach that puts partisanship to the side, and who will work to keep our communities safe and impartially pursue justice. In her short tenure as an interim US Attorney, she has degraded the office and pursued frivolous and politically motivated prosecutions. It’s clear that Alina Habba does not meet the standard to serve the people of New Jersey.
