NJ pay transparency law takes effect for employers statewide

A new law that requires in New Jersey to post salary ranges and benefits takes effect June 1.

Gov. Phil Murphy signed the New Jersey Pay and Benefit Transparency Act (NJPBTA) into law in November. The legislation mandates that employers must disclose salary, benefit and other compensation information in posting new job and transfer opportunities.

“Last year, I was proud to sign this legislation to increase workplace transparency and support hardworking New Jerseyans across the state,” said Murphy. “This law builds upon my administration’s efforts to make the Garden State more equitable, ensuring that critical salary and benefits information and career advancement opportunities are accessible to our workers.”

New Jersey Department of Labor & Workforce Development set up a special resource page here about the new law with additional information.

Key details about the new law:
  • Applies to employers with 10 or more employees over 20 calendar weeks that do business, employ people as well as take applications for employment within the state
  • Applies to both private and public employers — including state, counties and local government bodies
  • Employers must disclose:
      • The hourly wage or salary
      • A general description of benefits
      • Other compensation programs in postings for new job or transfer opportunities;
      • Additionally, must also make reasonable efforts to notify current employees of promotional opportunities
  • Covers job posting in a number of formats, such as:
      • Job search websites
      • Print advertisements
      • Company newsletters
      • Emails
      • Social media, and more
  • May also apply to employers based outside of New Jersey if they have employees working in the state – or conduct business here

This law empowers workers to make informed decisions and encourages employers to compete fairly, driving progress in our labor market.”
